A senior secondary school student, Ayuba Musa, has been sentenced to 14-year imprisonment by a Kano High Court, presided over by Justice A.T. Badamasi, for having sexual intercourse  with an under aged girl (name withheld), aged 10 in Bebeji Local Government Area of the state.
The court, sitting at Audu Bako Secretariat in the state capital,claimed that the prosecution had adduced the requisite evidence to prove beyond reasonable doubt and convince the court to convict Ayuba for the alleged offence filed against him.
The prosecution had told the court that the convict, on April 19th, 2017, had lured his victim into his private room, located at Ruwan Kaya Quarters in Tiga Village, Bebeji Local Government Area of Kano State.
Testifying before the court, the 10-year old victim told the court that when the convict lured her into his room, he turned on a television set and then asked her to fondle his private part.
She further told the court that Ayuba removed her pant and then penetrated her private part using his penis,adding that during the penetration, she felt a sharp pain in her private part.
Telling the court that the pain was unbearable and continued until she got home, the victim said she had to narrate what transpired to her mother, following queries from her and thereafter, the case was reported to the police.
He accused denied the allegation levied against; however, on conviction, he pleaded for leniency from the court, informing that he is an SS 2 student, adding that he caters for his mother, who was old and sick.
In its judgment, the court held that the victim was unshaken in her testimony, even when she underwent rigorous cross-examination from thee defence counsel, noting that she was a witness of truth.
Justice Badamasi also held that the defendant, through his counsel did not discredit the report of the police and the testimony of the victim, which he said corroborated one another.
Delivering judgment, Justice Badamasi said he has no doubt in his mind that the prosecution has proven its case beyond reasonable doubt, adding that a case of rape has been proven against Ayuba, and ruled that the secondary school student should proceed to serve 14 years in jail without an option of fine.
