High Court sitting in Calabar, yesterday adjourned ruling in a case between the Inspector General of Police IGP, Usman Baba, and Ugorji Nwabueze, over alledged impersonation of the position of Ohanaeze Ndigbo’s president in Cross River State.
The IGP, Baba had a month ago in suit No: HC/82C/2021, dragged the President of Ohanaeze Ndigbo in Cross River State, Barr. Nwabueze to court for alleged impersonation and forgery of the position of president of Ohanaeze Ndigbo.
The court, presided over by Justice Bassey Ebuta averred until the defense counsel, Prof. Jacob Dada, presents the authority that he cited before the court, the court cannot give any ruling on the case.
The presiding judge called the case for hearing at court three in State High Court complex, had earlier adjourned the case to March 8, to enable parties involved in the case present the authorities that they had cited to enable the court proceeds with the ruling.
However, while Mr Alex Ewa, counsel to the IGP complied, Dada’s authority was not made available to court.
Consequently, the presiding judge ordered the defence and prosecution counsels to pick a fresh date for hearing to enable the court make a ruling on the case.
In a brief interview with journalists shortly after the court session at the High Court, Mary Slessor Avenue Calabar, Effiom Ago Esq, one of the counsels to Nwabueze, who spoke in company of Prof. Dada, stressed that ruling on the case couldn’t go on on the last adjourned date, as parties in the case needed to present an authority sited in court by the defense counsel.
He said, “To that end, we cited an authority which unfortunately we couldn’t make available to the court today, consequently upon that, the ruling could not be delivered.
“A further date of March 17 has been picked to enable us supply the authority to the judge for the ruling to take place.”
